ظاهرة عشائرية هزت قيم المجتمع العشائري والقانوني في العراق ، ففي واحدة من القضايا الاجتماعية التي لم يألفها المجتمع العراقي، كشفت حادثة مؤلمة عن استغلال فاضح للسلطة العشائرية، عندما أقدم شيخ عام على تبرئة ابنه المتورّط بالاعتداء على امرأة، مستخدماً شاهد زور لتوريط شاب بريء من أبناء عشيرته. القضية التي تثير الرأي العام لم تقف عند هذا الحدّ، بل تضاعفت خطورتها بعد انكشاف أن الشيخ الثاني، الذي شارك في ترتيب شهادة الزور، يشغل موقعاً ضمن لجنة فكّ النزاعات العشائرية المتعاونة مع مديرية شؤون العشائر في وزارة الداخلية، ما يجعل الجريمة مركّبة أخلاقياً وقانونياً. المعلومات المؤكدة تشير إلى أن مقطع فيديو موثَّق ظهر فيه شاهد الزور وهو يعترف بتواطئه مع الشيخين لتبرئة ابن الشيخ الحقيقي من التهمة، مؤكداً براءة الشاب المسجون ظلماً.
وقد أثبتت الأدلة الجنائية صحة المقطع، إلى جانب خمسة شهود أكدوا الرواية أمام الجهات المعنية. هذه الواقعة المؤلمة تكشف خللاً خطيراً في بنية العدالة الاجتماعية، حين تتغوّل الأعراف على القانون، ويتحوّل المنصب العشائري إلى وسيلة حماية للمجرمين بدلاً من صون الحق.
الختام: إن كوابح هذه الظاهرة تبدأ من إعلاء سلطة القانون فوق أي نفوذ عشائري أو اجتماعي، وتفعيل دور وزارة الداخلية في مراقبة لجان فضّ النزاعات العشائرية، مع محاسبة صارمة لكل من يسيء لمقام العدالة أو يستغل العرف لإخفاء الجريمة. فحين يُسجن البريء ويُكرَّم المذنب، لا تهتزّ القوانين فقط… بل ضمير المجتمع كله.
Investigative Report – A Disturbing Social Phenomenon Unfamiliar to Iraqi Society
In a shocking incident that has stirred public opinion in Iraq, a tribal chief allegedly abused his authority to exonerate his son, who was accused of assaulting a woman—by fabricating testimony that led to the wrongful imprisonment of an innocent young man from his own tribe. The scandal deepened when it was revealed that a second tribal leader, who helped orchestrate the false testimony, serves as a member of a dispute-resolution committee affiliated with the Ministry of Interior’s Tribal Affairs Directorate—turning the case into a striking example of both moral and legal corruption. According to verified information, a recorded video confession shows the false witness admitting his involvement in collusion with the two sheikhs to clear the real perpetrator, confirming that the imprisoned young man was completely innocent. Forensic examination has validated the video’s authenticity, and five eyewitnesses have also corroborated the account. This disturbing episode exposes a serious breach in Iraq’s moral and social justice fabric—where tribal influence overshadows the rule of law, and leadership titles become shields for wrongdoing instead of instruments for justice. Conclusion: The only way to curb such phenomena is to reinstate the supremacy of law over tribal influence, empower the Ministry of Interior to monitor tribal dispute-resolution committees, and hold accountable anyone who manipulates customary power to conceal crimes.
